Less than a week after a mad dash at a Long Island, N.Y. Wal-Mart for post-Thanksgiving sales killed one employee, two customers are suing the store.
A temporary worker was crushed to death early Friday morning when shoppers rushed into the store.
Jdimytai Damour, 34, died as he and other employees attempted to unlock the doors of a store at 5 a.m. Friday. An autopsy discovered that Damour died of asphyxiation after being trampled.
Customers Fritz Mesadieu, 51, and Jonathan Mesadieu, 19, were "literally carried from their position outside the store" and are now "suffering from pain in their neck and their back from being caught in that surge of people" that rushed into the Wal-Mart, according to an attorney.
The lawsuit alleges that the Mesadieus' injuries were a result of "carelessness, recklessness, negligence."
In a claim directed at the Nassau County police department, the father and son also contend that they "sustained monetary losses as a result of health care and legal expenses ... in the sum of $2 million."

My first thoughts after reading this story is that the police should turn around and arrest these two people for being part of the mob that had no consideration for human life and trampled the Walmart employee. Looks like others feel the same way. Let them sue, but they did gather with the mob and did get too close. If they were worried about their well being, then they should have backed to a safe distance from the mob and waited for the people to go into the store. Then they could have proceed to enter. However, they were in the mad rush to get their TV's for $388.
Just another example of our litigation-crazed society. Someone must be made to pay for every misfortune. Usually this is the involved party with the deepest pockets (the lawyers won't waste their time on the people who directly inflicted alleged injury on their clients). These people placed themselves in the middle of a mob in order to get a bargain and now say that Wal-mart is responsible for their injuries? Give me a break. This just another attempt to make a quick buck.
