N.Y. Maintenance Man Nabbed in Comp Scheme

New York State Insurance Fund CEO David Wehner announced the arrest of a Rome, New York man who had been receiving benefits from NYSIF while working for the Masonic Care Community in Utica, New York in a case of workers’ compensation fraud with a potential estimated value of more than $82,000.

Authorities arrested Clarence Ward Burk aka Ward Burk last month, charging him with offering a false instrument for filing, insurance fraud and fraudulent practices – all felonies.

Investigators said Burk, 73, had been receiving workers’ comp benefits stemming from a back injury he sustained while working as a fabricator at the now-closed Revere Copper Factory in Rome in 1985. According to investigators Burk allegedly denied at least 16 times that he had returned to work in signed forms he submitted to NYSIF.

However, surveillance showed Burk had been working in the boiler room of the health care facility run by the Masons in Utica allegedly since 2004 while continuing to collect workers’ comp benefits. Investigator said the actual fraud allegedly committed by Burk amounted to $20,089.

NYSIF estimated the future savings in the case as a result of the arrest at $55,904.
