On Jan. 30, 2002, Anderson filed a workers' comp claim alleging industrial injuries arising from an accident at an off-shore oil rig. Anderson 's treating physician kept the defendant off work based on the defendant's reported representations that he was too injured and in too much pain to do any type of work. The defendant then began receiving tax-free wage benefits. These benefits eventually totaled over $35,000.
An investigation was initiated. During the investigation, the defendant was surreptitiously videotaped working on his sail boat. The surveillance, conducted over a four-month time period, reportedly showed Anderson performing numerous tasks using his allegedly injured hand. Two medical doctors and a vocational rehabilitation expert testified at trial. When shown the surveillance tapes, all three witnesses formed the opinion that the defendant lied about the true nature and extent of his injuries and physical limitations.
Anderson 's sentencing is scheduled for Oct. 28. The defendant is facing up to five years and eight months in state prison. Additionally, Anderson faces fines and an order that he refund the benefits he received as a result of his fraudulent conduct.
