Giron was sentenced to time served in jail and a three-year conditional discharge. He paid $4,800 restitution.
According to authorities, Giron had reported a work-related injury to his right hand and back while working as a warehouse clerk in June, 2001. He was receiving $200 a week in workers’ compensation from NYSIF.
Giron was reportedly found to be working as a warehouseman since May, 2006 while denying to NYSIF that he was employed. He had unlawfully received $4,800 in compensation payments prior to his arrest in January, 2008.
In this case, the potential future savings to NYSIF is $171,529 in benefits that would have been paid to Jose Giron had the fraud not have been discovered.
Giron also signed an agreement with NYSIF ending his workers’ comp claim.
