Repairman Pays Restitution in Work Comp Case

New York State Insurance Fund CEO/Executive Director David Wehner announced the conviction of a 57-year-old Coram, NY, man who paid nearly $10,000 in restitution to NYSIF for workers’ compensation benefits he received fraudulently.

Vito Molesi pleaded guilty to attempted fraudulent practices on July 30, and was ordered to pay NYSIF $9,630 restitution in a case involving a workers’ comp injury he claimed as an appliance repairman. He also signed an agreement closing his workers’ comp. case.

Molesi was collecting $400 a week in workers’ comp benefits when he was arrested for working while receiving benefits. As a result of Molesi’s conviction and disallowance of his claim, NYSIF estimates a potential savings of $246,000 on his claim.

Authorities originally arrested Molesi in August 2007 during an investigation by Suffolk County District Attorney Thomas Spota’s Office of an unlicensed appliance repair business in which Molesi was employed. That led to his arrest in November 2007 by the Suffolk DA’s Insurance Crime Bureau for a Workers’ Comp Law violation as a felony.

Investigators said Molesi had been working for the unlicensed company during 2007, while certifying to NYSIF that he was not employed following a back and knee injury he claimed to have suffered on a previous job in 2006.
